Welcome to the website operated by Lamb's Beverage Company dba Original Henry Lambert's Beer ("Company," "we," "us," or "our"). By accessing or using our website at www.lambertsbeer.com (the "Site"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Site.
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
You must be at least 21 years of age to access, browse, or use this Site. By using this Site, you represent and warrant that you are at least 21 years of age. This requirement applies regardless of the legal drinking age in any jurisdiction outside the United States.
We reserve the right to request proof of age at any time and to deny access to any individual who cannot verify that they meet the minimum age requirement. Any misrepresentation of your age constitutes a violation of these Terms and may be reported to the appropriate authorities.
Lamb's Beverage Company is based in New York City, New York, and operates in compliance with the New York State Alcoholic Beverage Control Law ("ABC Law") and the rules and regulations of the New York State Liquor Authority ("NYSLA"). All sales of alcoholic beverages through this Site are subject to applicable federal, New York State, and New York City laws and regulations.
We hold the appropriate licenses and permits required by the NYSLA to sell and distribute beer. All sales are made from our licensed premises in New York City, New York.
We may only sell and ship beer to jurisdictions where we are legally permitted to do so. It is unlawful to sell or deliver alcoholic beverages to any person under 21 years of age, any visibly intoxicated person, or any habitual drunkard. We reserve the right to refuse any sale at our discretion and in compliance with applicable law.
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
Certain features of the Site, including the ability to purchase products, may require you to create an account. When registering, you agree to provide accurate, current, and complete information, including your date of birth for age verification purposes. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account information.
All products displayed on the Site are subject to availability. We reserve the right to discontinue any product at any time and to limit the quantities of any product we offer.
Prices for products are subject to change without notice and are listed in U.S. dollars. All applicable taxes, including New York State and New York City sales taxes, will be calculated and added at checkout. We make every effort to display accurate pricing; however, errors may occur. If a product is listed at an incorrect price, we reserve the right to refuse or cancel any orders placed for that product, whether or not the order has been confirmed or your payment method has been charged.
By placing an order through the Site, you represent that you are at least 21 years of age, that the products ordered will be used only in a lawful manner, and that all information you provide is accurate.
The sale and shipment of beer are subject to applicable federal, New York State, and local laws. We ship to addresses within New York State and to other jurisdictions where such shipment is permitted by law. Certain states prohibit or restrict the direct shipment of alcoholic beverages to consumers; we will not ship to any jurisdiction where doing so would violate applicable law.
An adult signature from a person aged 21 or older is required for all deliveries of beer. The delivery carrier or our delivery personnel will verify the recipient's age by checking a valid, government-issued photo identification at the time of delivery. If no eligible adult is available to accept and sign for the delivery, or if the recipient cannot provide valid identification, the delivery will not be completed and the shipment may be returned to us. Additional shipping charges may apply for redelivery.
For deliveries within New York City, we may use our own delivery personnel or third-party licensed delivery services. All delivery personnel are trained to comply with New York State and New York City laws regarding the sale and delivery of alcoholic beverages.
Title and risk of loss for all products pass to you upon delivery to the carrier or, for local deliveries, upon acceptance at the delivery address.
We accept the payment methods indicated on the Site at the time of purchase. By providing a payment method, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your payment method for the total amount of your order, including the price of products, applicable New York State and local taxes, and shipping charges.
If your payment method cannot be verified, is invalid, or is otherwise not acceptable, your order may be suspended or canceled.
Due to the nature of alcoholic beverages and applicable regulations, including New York ABC Law requirements, all sales are generally final. However, if you receive a damaged or defective product, please contact us within 7 days of delivery at the contact information provided below, and we will work with you to resolve the issue.
Refunds, if granted, will be processed to the original payment method within a reasonable time frame. We reserve the right to refuse returns or refunds at our discretion, subject to applicable law. Opened containers of alcoholic beverages cannot be returned.
